1. Who we are.
3Designers CAD Studio, S.R.L. (hereinafter, “3Designers” or the “Company”) is a Dominican company with its registered address at Avenida Rómulo Betancourt No. 341, Edificio Grupisa, Bella Vista, Santo Domingo de Guzmán, Distrito Nacional, Dominican Republic, and National Taxpayer Registry (RNC) No. 130490732. The Company engages, among other activities, in the distribution and sale of SOLIDWORKS (Dassault Systèmes) software and 3D CAD solutions, and in the provision of training, technical support and implementation services.
3Designers owns and is responsible for the websites www.3designersdr.com, www.3designerscad.com, www.3designerscad.studio and any microsite, subdomain, application, form or digital channel made available by the Company (collectively, the “Site”).
2. Purpose and acceptance.
These Terms and Conditions (the “Terms”) govern access to and use of the Site by any person visiting it, with or without prior registration (the “User”). Use of the Site implies knowledge and full acceptance of these Terms. If the User disagrees with any of their content, they must refrain from using the Site.
These Terms are supplemented by the Site’s Privacy Policy and Cookie Policy, and by any specific conditions applicable to particular products, services or features offered through the Site.
3. Definitions.
Site: the website www.3designersdr.com and its microsites, subdomains, applications, forms and other 3Designers digital channels.
User: any natural or legal person accessing the Site, with or without prior registration.
Content: texts, images, graphics, videos, software, databases, source code, trademarks, logos and any other material made available on the Site.
Services: sales, licensing, training, technical support and implementation solutions offered by 3Designers through the Site or arising from the User’s interaction with it.
4. Legal framework.
These Terms are governed by the laws of the Dominican Republic, particularly:
Law No. 126-02 on Electronic Commerce, Documents and Digital Signatures.
Law No. 358-05, General Law for the Protection of Consumer or User Rights.
Law No. 172-13 on Personal Data Protection.
Law No. 53-07 on High-Technology Crimes and Offenses.
Law No. 65-00 on Copyright and Law No. 20-00 on Industrial Property.
5. Conditions of access and use.
Access to the Site is generally free of charge. Certain sections, content or features may require prior registration or acceptance of specific conditions.
The User undertakes to:
Use the Site lawfully, diligently and respectfully, in accordance with these Terms, applicable law and good faith.
Refrain from introducing viruses, Trojan horses, malicious code or any other element capable of damaging 3Designers’ or third parties’ systems.
Refrain from reverse engineering, disassembly or attempts to access restricted areas, source code or Site infrastructure.
Not use the Site to distribute content that is unlawful, offensive, misleading, contrary to morality or public order, or that infringes third-party rights.
Respect the intellectual and industrial property of 3Designers, Dassault Systèmes and any other holder of rights over Site Content.
6. Intellectual and industrial property.
All Site Content is owned by 3Designers or its licensors (including Dassault Systèmes) and is protected by Law No. 65-00 on Copyright, Law No. 20-00 on Industrial Property and applicable international treaties. Its reproduction, distribution, transformation, public communication or any other exploitation, in whole or in part, is prohibited without the prior written authorization of the corresponding rights holder.
SOLIDWORKS, Dassault Systèmes and other third-party trademarks or distinctive signs appearing on the Site belong to their respective owners. Their mention does not imply any transfer of rights, sponsorship or commercial affiliation beyond the official distribution relationship maintained by 3Designers.
7. Links to third-party sites and social networks.
The Site may include links to third-party websites, social networks or platforms. 3Designers does not control or assume responsibility for their content, policies, practices or services, or for any damage their use may cause the User. Visiting such sites is solely the User’s responsibility, and the User is advised to review their terms and policies before providing information.
8. Personal data protection and cookies.
The processing of personal data provided by the User through the Site is governed by the Privacy Policy published on the Site. The use of cookies and similar technologies is governed by the Cookie Policy, accessible from the footer and consent banner. By using the Site, the User declares that they have read these texts and understand their implications.
9. Electronic commercial communications.
3Designers may send the User electronic commercial communications about its products and services when there is a prior contractual relationship or when the User has given express consent. The User may withdraw consent at any time through the mechanisms indicated in each communication or by writing to privacidad@3designersdr.com.
10. Site availability and limitation of liability.
3Designers takes reasonable care regarding the availability, accuracy and updating of Site Content; however, it does not guarantee the complete absence of interruptions, errors, temporary unavailability or inaccuracies. 3Designers may suspend access to all or part of the Site for maintenance, security or any other reasonable cause, without giving rise to a right to compensation for the User.
To the fullest extent permitted by applicable law, 3Designers will not be liable for damage or loss arising from access to or use of the Site, unless it is the direct consequence of the Company’s willful misconduct or gross negligence. This is without prejudice to the non-waivable rights granted to consumers and users under Law No. 358-05.
11. Amendments to the Terms.
3Designers reserves the right to amend these Terms at any time to adapt them to regulatory, technical, operational or commercial changes. Amendments will be published on the Site with their effective date. Continued use of the Site after that date implies acceptance of the amendments. The User is advised to review this section periodically.
12. Applicable law and jurisdiction.
These Terms are governed by the laws of the Dominican Republic. To resolve any dispute arising from their interpretation or application, the parties submit to the competent courts of Santo Domingo de Guzmán, Distrito Nacional, without prejudice to alternative dispute-resolution mechanisms and the non-waivable rights of the User or consumer under Law No. 358-05.
